Questions using appeal

Problem 1

Why is an appeal not automatically a complete new trial?
Answer and explanation

Appellate review generally addresses claimed errors using the record and applicable standards. It does not ordinarily repeat all fact-finding with new testimony. The specific procedure and issue determine what can be considered and what remedy is available.

Problem 2

A fictional appeal court sends a case back for a required hearing. Does this establish that the claimant must receive the requested payment?
Answer and explanation

No. Remand for procedure does not necessarily decide substantive entitlement. Read the stated reason and disposition, then identify what the lower proceeding still must decide. Do not expand the remedy beyond the order.

Response criteria

  • Explain the relevant institution or economic concept accurately; show correct calculations where needed.
  • Connect supplied evidence and stated assumptions to an explained conclusion.
  • Compare feasible options and their effects on different people without stereotypes.
  • Identify a limitation, tradeoff, uncertainty, or condition that qualifies the conclusion.
